Hi,

Just received a charge back dispute from a customer that used one of our bays for total of $10.00. He said that his card was stolen and bank is giving his money back. Checked my CCTV and found customer swiping his card. Checked car tags and is register to customer so definitely was not a stolen card.

Bad news is that since Cryptopay is not a chip reader system, even if we have prove that customer is not telling the true we can not do nothing.

Merchant rep. told me that is a shame but they can not do nothing, he mentioned that carwashes owners are even going through law enforcement to recovery their money since is getting more common.

Have someone heard about this?

Yes. All you can do is sue the customer. Has happened to me in the past. Obviously not worth suing them, so you just laugh and think of the ways Karma will get them back.

It happens a lot. We have USA Tech card readers on our bill changers. We’ve had customers buy $40 worth of tokens at one wash, go across town to one of the other washes and buy $40 worth of tokens and when they get their statement they call their credit card company and dispute the charges and the credit card company will take off the charges. About the only thing you can do is to block there credit card. I wouldn't say that the Cryptopay card readers are out of compliance. There's no back signature, if there was a signature they wouldn't be able to get away with it as easy is it is now.

Hi Randy, fist thing I thought was blocking CC but merchant rep. told me that when someone call and report a fraudulet transaction/lost/stolen card bank immediately send a new on with different number.

You'd have to sue them for the lost amount plus court costs and your time spent pursuing the recovery to make it worth your while, but if you have video evidence of the person I don't see why it wouldn't be an easy win.

Court will not award you money for your time spent dealing with the lawsuit.

So obviously not worth it. Write it off, and move on.

How are you guys finding out the identity of the person disputing the charge and/or the identity of the person swiping the card? When I get dispute letters there is no cardholder name listed. Now that I think about it, Cryptopay lists the cardholder name under the transaction however my other processors do not. Also, I have lots of license plates and videos of people swiping but have no way of identifying or running the plate in Ohio.

Similar reports have happened by laundromat operators who have card acceptance. It seems to be more common in large metro areas!

Can someone elaborate on Randy's statement about the back signature being a potential answer to rogue chargeback problems???

In our area ... I have been to places & paid by CC where they said to sign my name with my finger on their touchscreen. Also, some places ... even big box stores have said the name does not have to match ... which opens the door for me to just temporarily borrow a business CC with my part time help rather than issuing him his own King Koin card.

Sometimes after I sign ... I point out about how good my signature looks having be trained early on ... by the Sisters of Notre Dame ... to have decent handwriting. Sometimes the clerk will banter back at me & say just a simple X is good enough for him or her!

Wouldn't stop me. The enjoyment I'd get out of taking someone to task would be reward enough.

Similar to dumping on my site - we've taken people to court over it. It costs us money in the long run, but I deemed it to be a worthwhile endeavor.

Just had this with "Pay at the {Pump" Customer disputed July 6 Charge for $16.00 because they had a July 4 Charge for $15.02 ns claimed the second one was "Duplicate" Gave all documentation to processor. Since their bank took their side I would have to agree to go to arbitration and py $500 if I lost. WE NEED A CLASS ACTION.

I would go to the police with the proof of him using his card and have him charged for theft of services. Let the police know that he told his credit card company his card was stolen and used at your place yet it was him that used it!!

They told the credit card company it was a "Duplicate Charge" Although the disputed charge was for $16 pay at the pump on 7/6/19 and the initial charge was $15.02 on 7/4/19. If I went to the Chicago cops with this I am sure it would be there #1 Priority:)

Depending on the area ... the officer might have it go through the local city attorney???

I remember being at a major presentation about 6 months ago on credit card security for small business at a local university put on mainly by UND & the Small Business Administration. I did ask the presenter & to the attendees. Most of the attendees were very high paid computer experts.

I asked what law firm locally would be "the goto" for legalities that come up. Dead silence in the room of over 50 attendees!

I would call the police and explain the situation to them about the charge and make them file a no trespass order. That way they can never come on your property again.

My concern there would eventually be a potential future long list of no trespass orders. Our local PD seems to have been plenty inconsistent when to "no trespass". For awhile in the past they seemed to demand "permanent no trespass" or face no help from them. Lately .... it seems like they are more & more suggesting just a "24 hour no trespass". The PD vehicles have been known to block the entrance to our car wash for a whole 30 minutes apprehending somebody on "warrant" ... a non customer pulled over into a bay! Every locality is different ... but based on our experience ... we rarely use a "permanent no tresspass". IMHO it could be something tough to enforce depending how "on top of things attended" a specific self service car wash is.

Soapy ... just my guess & no offense intended .... but I am thinking you have a more pull with your local police commissioner &/or city attorney than some of the rest of us!

I just throw those letters from the CC company right in the trash. Not worth the time.
