Hum, I too am positive that is "fraud". We have always only gave tokens as a form of refund. (by hand or mail) But, maybe you are not equipped for tokens. Oh well, they do elliminate lots of criminal issues.

Went to the bank and after they told me I was S O L they made me a copy of the check and I noticed that it was not endorsed on the back. When I asked about it they told me they would get back to me.
Bad or missing endorsement? They must credit your account. Don't accept another answer.

Sometimes my bank on lesser checks they will just stamp on back "deposit only" In our area for many years now, the banks tend to never release funds from a check to the person instantly. That is why I was thinking that there could be a time factor if the discrepancy was spotted online quick enough.

I have been involved in some really heavy transactions where a lawyer was involved & the other party insisted on a "cashiers check" that supposedly was the same as cash --- supposedly less safeguards than a check or credit card. Anybody who has had fun with credit card disputes might give us a clue that is not all blue sky either.

I agree with Earl. Don't accept any response from your bank other than a reimbursement. Keep asking for the next higher person. Your bank was at fault.

The bank is in fact liable since the check was not properly endorsed. If the attitude from the bank is SOL, the fraud may have actually happened at the bank itself with a possible teller involvement. The bank has the attitude of an odd defensive stance. Go to the police. Get them involved. You obviously have the customers address that you sent the refund to, their name, etc. Plus, the police could verify when the customer came to the bank through their cameras. They also could verify who the teller was at the time of the transaction.
