You might check the label on the can of wasp and hornet spray, something about it being a felony to intentionally misuse the product. Keeping it on hand with the intent of spraying it in someone's eyes might go over worse than just shooting them with a gun. At the very least you'd probably want to claim that it was the first thing within reach you grabbed when trying to defend yourself. A good pepper spray will shoot a stream 10-12 feet and won't do permanent injury.

Worrying about a legal problem if I spray a lowlife with wasp spray is real low on my worry scale.

On the surface I have to believe that using a can of wasp spray cannot be compared to using a gun to defend yourself or your property.
