Tunnel Damage Claim Help!!!

My son bought his wife a new BMW M3 last week and today she took it through a tunnel wash. As she exited the ground effects were damaged by a trough/railing part of some kind.

The car wash attendent says they're not liable. What say you? I say that if the car sat too low, it was their responsibility to tell her before she entered.

Red, 2 things. Each state has a minimum height requirement for cars. I once had a kid with a low rider tear his muflers off in a bay that had a 1 1/2 inch high wheel choke. He called the cops and they came over and checked his car height and the height of the wheel choke. It turned out his car was too low and was illegal to even drive so they told him I was not at fault and for him to hit the road. As long as the M3 is higher than minimum you should be fine.
2. Most tunnels will say not responsible for aftermarket products. As long as the M3 was stock I think you should have a claim. Insurance will probably look at it as a no fault situation anyway and cover it.

If it is stock and not aftermarket and they allowed it to go through the tunnel they should be responsible. If they don't agree you would have a good case in small claims court. Most likely, as Soapy has already said, the insurance companies will probably work it out.

My son got off work abd discovered that the scratch was on the undercarriage, most likely from a speedbump. My son caught the attendant and told him: Um, lets pretend that you never saw this car before.

Don't you just love that. When my son was 16 he came home and said that he had scratched the car. I said no problem and we would look at it in the morning when it was light. In the morning there was no car in the driveway. Turns out that he had run it into a ditch and hit a tree. We went and looked at it and insurance totaled it. SCRATCH. Yea right.

Not long ago I got a call that my auto treadle had damaged the ground effects on her new Acura TL. By the time I got there, her husband was there and working at fixing the displaced plastic parts. I got out my trusty ruler and measured the height of the treadle, guide rails and the plastic ground effects on the car. The auto parts were 5” off the ground. The tallest part of the car wash was 4”. I told the lady that I didn’t know what she ran over, but she was not going to blame the damage on my wash. Her husband never said a word, but did roll his eyes a lot. I got the feeling this was not the first time she had damaged her vehicle and tried to blame someone else.
